1. Scope
These Terms & Conditions apply to all orders placed by consumers through the online gallery NOAIGALLERI.com
Any differing or conflicting terms requested by the customer shall not apply unless expressly confirmed in writing before placing an order and accepted in writing by NOAIGALLERI.com.
By placing an order, the customer confirms that they have read and accepted these Terms & Conditions before completing the purchase.
2. Operator and Legal Information

No store addresses, we only trade online with digital files and downloads.

3. Swedish consumer sales act
The Swedish Consumer Sales Act (Konsumentköplagen, SFS 2022:260) provides strong protection for buyers, allowing a 3-year right to complain about faulty goods. It mandates that sellers must repair, replace, or refund defective items. It applies to all physical goods, digital content, and services sold by businesses to consumers.
Key details of Swedish consumer protection:

Three-Year Warranty Period: Consumers can report defects up to 3 years after purchase, with a 2-year "presumption of fault" period where the seller must prove the fault did not exist at delivery.

Remedies for Defects: The seller is responsible for repairing or replacing the item at no cost to the consumer. If that fails, a price reduction or cancellation of the purchase is possible.

Distance Selling: The Distance and Off-Premises Contracts Act gives consumers a right of withdrawal (usually 14 days) for online purchases.

Consumer Services Act: Covers services, ensuring they are performed professionally and conform to the contract.

Dispute Resolution: The National Board for Consumer Disputes (ARN) provides free, binding arbitration for conflicts between consumers and businesses.

4. Contract
The product listings in our online shop are non-binding invitations to place an order.
By clicking “Order “ “ Purchase “ “Buy Now” or “Complete Order”, the customer submits a binding purchase offer.
We accept this offer by sending an order-confirmation email, thereby concluding the purchase contract.
The confirmation includes essential order information and serves as your proof of contract.
5. Storage and Provision of Contract Documents
We store the contract data for internal record-keeping.
You will receive an order-confirmation email that includes:

If you created a customer account, you can also view your past orders there.
The legally binding version is the one sent to you by email at the time of purchase.
6. Product Information, Prices and Currency
We do not stock physical goods, all our products are digital downloads or made to order.
All essential details (dimensions, materials, printing process, etc.) are shown on each product page.
All prices are stated in euros and include all applicable taxes and duties where required by law.
As NOAIGALLERI operates under the Swedish tax regulation, prices are final and 25% VAT are included.
International Pricing and Currency.
NOAIGALLERI displays prices in euros, shipping is included for the EU zone
Prices may vary slightly between regions due to currency exchange rates, local production, or shipping costs.
The prices and currency shown at checkout are final and binding for that specific order.
Shipping costs, if applicable, are shown separately before checkout.
7. Payment
We only accept payments with credit cards and bank transfer after placing an order. methods are shown during checkout.
The total amount is due upon order confirmation.
In case where orders should be paid by bank transfer, if payment is not confirmed within 3-5 working days G&M Scandinavia AB may cancel the order.
No production will start before receiving the payment.
8. Delivery and Shipping
All NOAIGALLERI artworks are produced and fulfilled by our trusted printing partner theprintspace.com.
Production and Shipping are handled by theprintspace.com and it is available to all EU countries.
For export outside of the Eu Zone other regulations apply.
Typical delivery time: 7 – 14 working days, depending on production and destination.
A tracking link is provided once your order is shipped.
You must understand that shipping and handling are out of our control but we will do everything in our power to keep you up to date. Shipping delays are an estimate from previous data and they may vary depending on the shipping companies and country of origin and country of destination. we can not be held liable for any delays that are out of our direct control.
9. Made-to-Order Production & Exclusion of Withdrawal Rights
All NOAIGALLERI artworks are made-to-order fine-art prints, produced individually after your order have been placed.
In Sweden, made-to-order (custom-made) goods are regulated under the Consumer Sales Act (konsumentköplagen) the statutory right of withdrawal does not apply once production has begun.
This exemption is clearly stated before checkout. Please check sizes, materials and details carefully before ordering.
10. Right of Withdrawal only applicable on physical products stored at our premises.
Swedish law (Distansavtalslagen) grants consumers a 14-day right of withdrawal for most online purchases starting the day after receiving the item or signing a service contract. You can cancel without reason but the shipping costs are not refunded and you must pay for return shipping. It does not apply to physical stores, custom-made goods, or sealed hygiene items.
The Swedish Right of Withdrawal:

Timeline: The 14-day cooling-off period begins the day after you receive the goods or enter a service contract. If the period ends on a weekend or public holiday, it is extended to the next working day.

Notification: You must notify the seller within the 14-day period that you intend to cancel. Using the seller's or Swedish Consumer Agency's (Konsumentverket) form is recommended, but not mandatory.

Return Costs: the customer is responsible for the return costs.

Refunds: we will refund 14 days after receiving the item after inspection as the item must return in the same condition as when it was sent, if the item has been used or damaged you won’t be refunded, the shipping costs are not refunded, we will process the refund when we receive the goods.

Exceptions:

Customized/Personalized Goods: Items made to your specifications.

Perishable Goods: Food or items that spoil quickly.

Sealed Hygiene/Audio/Video Items: If the seal is broken (e.g., cosmetics, software, CD/DVD).

Physical Store Purchases: There is no legal right of withdrawal in physical stores, though many offer it voluntarily.

Missing Information: If the seller fails to provide mandatory information about the right of withdrawal, the period can be extended by up to 12 months.
If you are a business (B2B), these consumer protection laws do not apply.
To summarise
Only physical goods stored in our premises qualify to be returned and refunded after the legal period. If you withdraw from such product, we will refund all payments excluding the shipping costs for physical goods stored at our premises. This will be mentioned in the description of the product within 7 days of reception of the return goods.
We may withhold the refund until the goods are returned and inspected thoroughly.
You bear the cost of return shipping unless otherwise stated.
If the goods were used, you lose your right for a refund.
11. Warranty
Swedish law gives online consumers a mandatory three-year right to complain
(reklamation) for faulty goods under the Consumer Sales Act (Konsumentköplagen)
Please note that color variations due to human eye interpretation, the nature of the artworks, computer screens, tablets , cell phones and the printing process might be slightly different in color, brightness, contrasts or paper texture compared to the digital or sample previews on the screens.
These are considered normal and do not constitute defects under consumer law.
Most of our artworks are digitized vintage negative films that carry Film grains that are tiny, random, light-sensitive silver halide crystals embedded in the emulsion that might appear as a defect for the non-trained eye, they also carry other imperfections such as film lines, patina due to age and wear, product traces, dust marks and other imperfections related to the negative films, the era and the digitalization process.
Those are not defects, there are part of the artwork authenticity and do not fall under the Consumer Sales Act (Konsumentköplagen) warranty.
The vintage negative defects that are present in an image are not considered as defect for the warranty.
If your artwork arrives damaged, you may request a replacement and for that you must contact NOAIGalleri within 24 hours of receiving your delivery.
Warranty claims are valid for two years from delivery.

Within the first 12 months, defects are presumed to have existed at delivery unless we prove otherwise.
NOAIGALLERI or theprintspace covers shipping costs for justified claims.
Anything related to the artwork is not considered as a defect as mentioned above, we only accept claims on the quality of the paper used and the printing process used.
12. Limitation of Liability
NOAIGalleri assumes no responsibility or liability for any injuries, losses, or damage resulting from the use or misuse of our products, directly or indirectly.
NOAIGALLERI is not responsible for any direct, indirect, incidental, special, or consequential damage arising from the use or misuse of our products.
In no event will G&M Scandinavia AB be liable for any loss or damage including, without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of this website.
We do not warrant that the website will be error-free or that the server is free of viruses.
We have no control over the nature, content, and availability of linked third-party websites and accept no responsibility for them.
The information, materials, and services on this website are provided 'as is' without any warranty of any kind.
No Warranty of Accuracy, we are not responsible for damages resulting from typographical errors, inaccuracies, or omissions
NOAIGALLERI reserves the right to correct errors or update information at any time without prior notice, even after a user has placed an order based on that information.

NOIAIGALLERI tries to be as accurate as possible, as transparent as possible and as clear as possible but in the unlikely event that we make a mistake, you cannot hold us legally responsible for it. We are only humans after all.
13. Retention of Title
Until full payment is received, all delivered goods remain the property of G&M Scandinavia AB.

All prices are subject to change without prior notice. We reserve the right to modify or discontinue any product or any part or content thereof without notice at any time.
15. Data Protection
NOAIGALLERI processes personal data in accordance with the EU General Data Protection Regulation (GDPR) and Swedish data-protection law.

16. Copyright and Intellectual Property
All artworks and images offered through NOAIGALLERI are protected by copyright law. The artist retains ownership of the copyright.
By purchasing a print, you acquire ownership of the purchased physical or digital copy only. The copyright is not transferred but The artist retains all copyrights of his artwork.
No rights of reproduction, distribution, or commercial use are transferred unless explicitly agreed in writing with the artist.
17. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR):

G&M Scandinavia AB is willing to participate in alternative dispute resolution before a recognised Swedish consumer arbitration board pursuant to the Alternative Dispute Resolution Act.

If any provision of these Terms & Conditions is invalid or unenforceable, the remaining provisions remain in effect.
The invalid clause shall be replaced by a valid provision closest in purpose and economic effect.
